Section 01Scope

In plain terms

This explains what we know about you, why we know it, who else sees it, and how to make us delete it.

This Privacy Policy describes how Piloga's LLC d/b/a PILOGA'S ("PILOGA'S," "we," "us") collects, uses, shares, and protects personal information when you visit pilogas.com, attend an outdoor class, buy a membership or drop-in, claim a free class, book private training, sign our waiver, or contact us.

It applies to our website, our email, and our in-person sessions at parks, beaches, trails, and campuses across San Marcos, Carlsbad, greater San Diego, and Mission Viejo. It does not apply to third-party sites we link to.

Section 02What we collect

2.1 Information you give us

2.2 Information collected automatically

When you use the Site, we and our providers may collect IP address, approximate location derived from it, device and browser type, operating system, referring page, pages viewed, time on page, and interactions such as clicks and form submissions, using cookies and similar technologies. See Section 6.

2.3 Information from others

We may receive information from Squarespace, Stripe, Mailchimp, and our advertising partners, and from you when you connect a social account or a friend refers you.

2.4 Location

We do not track your location. We email you the meeting point for each session; how you get there is between you and your own map app.

Section 03Health information

In plain terms

What you tell us about injuries, pregnancy, or heat sensitivity goes to your instructor so they can keep you safe outdoors. It is not used for advertising and we do not sell it.

Health and fitness details you share are treated as sensitive personal information under California law. We use them only to deliver the Services safely — so your instructor can offer modifications, so we can respond in an emergency at a location that may be some distance from medical help, and so we can keep accurate records.

We do not use or disclose your health information for advertising, profiling, or any purpose beyond providing the Services, except where you direct us to or the law requires it. It is never shared with Meta, Google, TikTok, or any other advertising partner.

PILOGA'S is a fitness business, not a healthcare provider. We are not a HIPAA covered entity and what you tell us is not protected health information under HIPAA. It is protected under this policy and under California law.

Section 04How we use it

  • Create and manage your account and membership, including tier switches.
  • Process payments and recurring membership charges, and prevent fraud.
  • Send transactional email: class schedules and meeting points, weather cancellations and location changes, receipts, automatic renewal acknowledgments, free-trial conversion reminders, price-change notices, annual renewal reminders, and cancellation confirmations.
  • Arrange and confirm private training sessions.
  • Provide safe instruction and respond to injuries or emergencies at outdoor locations.
  • Answer your questions and provide support.
  • Send marketing about classes, workshops, and pop-ups where you've opted in, until you opt out.
  • Measure and target advertising on Meta, Google, and TikTok. See Section 7.
  • Understand how the Site and our sessions are used so we can improve schedules, locations, and pricing.
  • Keep records the law requires, including records of your consent to automatic renewal and your signed waiver.
  • Enforce our Terms of Service and protect our rights, our instructors, and our clients.

Section 05Who we share it with

We do not sell your personal information for money. We share it with service providers who need it to run the business, under contracts limiting them to our instructions:

Waivers are collected and stored through our website. We may also disclose information to comply with law or valid legal process, to enforce our agreements, to protect the safety of any person, or in connection with a merger, acquisition, or sale of our business — in which case we'll notify you.

Section 06Cookies and tracking

We use cookies and similar technologies that are:

  • Strictly necessary — sign-in, cart, security
  • Functional — remembering your preferences
  • Analytics — Squarespace's built-in analytics, to understand how the site is used
  • Advertising — Meta, Google, and TikTok pixels, to measure and target our ads

You can control cookies through your browser settings.

Global Privacy Control. We honor the Global Privacy Control (GPC) signal. If your browser or an extension sends GPC, we treat it as a request to opt out of the sale and sharing of your personal information for that browser, and you don't need to do anything else.

Section 07Selling and sharing, and how to opt out

In plain terms

We don't sell your data for money. But we run ads on Meta, Google, and TikTok, and the pixels that make those ads work count as "sharing" under California law. You can switch it off.

California law defines "sale" and "sharing" broadly. "Sharing" includes disclosing personal information to advertising partners for cross-context behavioral advertising — which is what advertising pixels do, even when no money changes hands.

We share identifiers and online activity with Meta, Google, and TikTok for cross-context behavioral advertising. We do not sell personal information for money, and we never share health information with advertising partners.

7.1 How to opt out

You have the right to opt out. Any of these works:

  • Use the "Do Not Sell or Share My Personal Information" link in the footer of any page on this site.
  • Turn on Global Privacy Control in your browser or via a privacy extension. We honor it automatically.
  • Email hello@pilogas.com with "Do Not Sell or Share" in the subject line.

Opting out does not affect your membership, your price, or your access to classes. See Section 8 on non-discrimination.

We do not knowingly sell or share the personal information of anyone under 16.

Section 08Your California privacy rights

If you're a California resident, you have the right to:

  • Know what personal information we've collected about you, where it came from, why, and who we disclosed it to.
  • Access a copy in a portable format.
  • Delete personal information we hold, subject to legal exceptions such as completing a transaction or keeping records we're required to keep.
  • Correct inaccurate personal information.
  • Opt out of the sale or sharing of your personal information — see Section 7.
  • Limit our use of sensitive personal information to what's necessary to provide the Services. We already limit ourselves this way — see Section 3.
  • Not be discriminated against for exercising any of these rights. We won't deny you service, change your price, or give you a lower level of service because you made a privacy request.

You may use an authorized agent. We'll ask for proof of their authority and may ask you to verify your identity directly.

Section 09How to make a request

We'll confirm receipt within 10 business days and respond within 45 calendar days. If we need more time we'll tell you, and may take up to 45 additional days.

To protect your information we'll verify your identity before acting on a request, usually by matching details against our records or emailing the address on your account.

Section 10Email

Email is how we run this business. We don't operate a phone line, so it's also how we reach you.

Transactional email. Class schedules and meeting points, weather cancellations and location changes, receipts, billing notices, free-trial conversion reminders, renewal reminders, and cancellation confirmations. These are part of the service, not marketing. Because we teach outdoors, these messages matter — they're how you find out a session moved or got called off.

Marketing email. We send promotional email through Mailchimp and Squarespace only if you opt in. Frequency varies.

Opting out. Click unsubscribe in any marketing email, or email hello@pilogas.com. Opting out of marketing does not stop transactional email about your account, the schedule, or your billing — you need those.

Section 11Photos and video at sessions

We sometimes photograph or film sessions for our website, our ads, and social media. When we plan to, we'll say so at the start of class. Tell the instructor if you'd rather not be included and we'll keep you out of frame — no explanation needed.

If a photo of you is already published and you want it taken down, email hello@pilogas.com and we'll remove it from anything we control.

Our sessions happen in public places where others may photograph or film independently of us. We have no control over that.

Section 12How long we keep it

  • Account and attendance records: 3 years after your last activity.
  • Payment and tax records: 7 years, as tax and accounting law requires.
  • Automatic renewal consent records: at least 3 years, or 1 year after the membership ends, whichever is longer, as California law requires.
  • Signed waivers and health intake: 4 years after your last class, to cover the applicable claims period.
  • Marketing lists: until you opt out, plus a suppression record so we don't contact you again.

Section 13Security

We use reasonable administrative, technical, and physical safeguards, including encrypted connections, access controls limiting staff to what their role requires, and vetted service providers. No system is perfectly secure and we can't guarantee absolute security. If a breach affects your information, we'll notify you as the law requires.

Section 14Children

The Site and paid Services are intended for adults 18 and over. We don't knowingly collect personal information from children under 13. Where we permit minors to attend, a parent or guardian provides their information and consent. If you believe a child under 13 has given us information, email hello@pilogas.com and we'll delete it.

Section 15Other sites

Our Site links to other websites and social platforms, including Instagram and Facebook. We don't control them and aren't responsible for their privacy practices. Read their policies before giving them your information.

Section 16Changes to this policy

We may update this policy. We'll change the "Last updated" date at the top, and for material changes we'll give notice by email or on the Site before the change takes effect.
