Section 01Agreement to these terms

In plain terms

Taking a class or buying a membership means you agree to these rules. If you don't agree, don't book.

These Terms of Service (the "Terms") are a binding agreement between you and Piloga's LLC, a California limited liability company ("PILOGA'S," "we," "us," or "our"). They govern your use of pilogas.com (the "Site"), our outdoor group classes, private training, memberships, drop-in classes, workshops, pop-up events, mat rentals and sales, and any digital or recorded content (together, the "Services").

You accept these Terms when you create an account, agree to them at checkout, purchase a membership or class, claim a free class, reserve private training, or otherwise use the Services. If you do not agree, you may not use the Services.

Please read Section 4 (Memberships and automatic renewal), Section 5 (How to cancel), Section 6 (Your free first class), Section 12 (Weather), Section 15 (Health, risk, and release), and Section 21 (Limitation of liability) carefully. They affect your legal rights.

Section 02Who we are

Piloga's LLC, doing business as PILOGA'S, a California limited liability company.

PILOGA'S teaches outdoor Pilates and yoga at public parks, trails, lawns, and beaches across San Marcos, Carlsbad, greater San Diego, and Mission Viejo. We do not operate a fixed indoor studio. Class locations vary by session — see Section 11.

We handle all customer service by email. We do not operate a customer service phone line.

Section 03Eligibility and accounts

You must be at least 18 to buy a membership, claim a free class, or agree to these Terms. Participants under 18 may attend only where we expressly permit it, and only with a parent or legal guardian's written consent and signed waiver. A parent or guardian who enrolls a minor agrees to these Terms on the minor's behalf and is responsible for all charges and conduct.

You are responsible for your account credentials and for all activity under your account. Email hello@pilogas.com if you think your account has been used without permission. Memberships are personal to you and may not be shared, sold, or transferred unless we agree in writing.

Keep your email address current. Because we teach outdoors and don't require booking, email is how you find out about schedule changes, location changes, and weather cancellations — and it's how we send billing notices, renewal reminders, and cancellation confirmations. If we can't reach you, you may show up to a class that isn't happening.

Section 04Memberships and automatic renewal

In plain terms

A membership renews on its own and keeps charging your card until you cancel. We tell you the price and billing date before you buy, email you a receipt with cancellation instructions, and give you notice before any price change. There's no minimum commitment.

4.1 Your membership renews automatically

Every PILOGA'S membership is a continuous, automatically renewing subscription. When you enroll, we charge the payment method you provide on a repeating basis at the tier and interval you selected, and we keep charging it until you cancel. Your membership does not expire on its own and requires no further action from you to continue.

4.2 Tiers and pricing

Monthly plans renew every month on the same date. Annual plans renew every 12 months on the same date. What each tier includes is described on the Pricing & packs page. Prices shown exclude any applicable tax.

There is no minimum commitment on any tier. You can cancel at any time under Section 5.

4.3 What you agree to at checkout

Before you complete a membership purchase, we present the following clearly and conspicuously, and ask you to affirmatively consent by checking a box that is not pre-checked:

  • The recurring price and billing frequency for the tier you chose.
  • The date of your first charge and when recurring charges begin.
  • That there is no minimum commitment.
  • That the plan renews automatically until you cancel.
  • Our cancellation policy and how to cancel, summarized in Section 5.

Checking that box is your express affirmative consent to the automatic renewal terms. We keep a record of it. We will not charge you for a recurring membership without it.

4.4 Your acknowledgment email

After you enroll we email an acknowledgment to the address on your account, repeating the automatic renewal terms, the cancellation policy, and step-by-step cancellation instructions in a form you can keep. If it hasn't arrived within 24 hours, check your spam folder, then email hello@pilogas.com.

4.5 Billing dates

Your billing date is set when you enroll and recurs on the same day each period. If that date doesn't exist in a given month — the 31st, for example — we bill on the last day of that month. Charges are made in advance for the upcoming period.

4.6 Switching tiers

You can switch between Bronze, Silver, and Gold, or between monthly and annual billing, from your account at any time. Upgrades take effect immediately and we charge the difference on a prorated basis. Downgrades take effect at the start of your next billing period. Switching tiers is not a cancellation — your membership continues to renew automatically at the new tier.

4.7 Price changes

We may change membership prices. If we do, we will email you a clear and conspicuous notice of the new price and how to cancel at least 7 days and no more than 30 days before it takes effect. If you don't want the new price, cancel before that date. Continuing after it means you accept the new price.

4.8 Renewal reminders

Annual memberships run for a term of one year. For every annual membership, and anywhere else the law requires it, we send a reminder at least once a year with the automatic renewal terms, the date of the next charge, and how to cancel.

4.9 What your membership includes

Class allotment, guest privileges, private training rates, and any other benefits are described on the Pricing & packs page. Schedules, instructors, and locations change — see Sections 11 and 12. If we materially reduce your tier's benefits, we'll notify you and you may cancel under Section 5.

Section 05How to cancel

In plain terms

You signed up online, so you cancel online. Go to pilogas.com/cancel and click the cancel link. No phone call, no sales pitch, no explanation required.

Cancel your membership

  1. Go to pilogas.com/cancel and click the cancel link. This is the fastest way and it's available any time.
  2. You can also reach the same cancel link from the Contact us page, or from the footer of any page on this site.
  3. Or email hello@pilogas.com from the address on your account. We process cancellation requests within 2 business days and confirm by email.

5.1 Cancel the same way you signed up

You enrolled online, so you can cancel online — without extra steps, without having to speak to anyone, and without navigating retention offers you didn't ask for.

5.2 When cancellation takes effect

Cancelling stops all future charges. Your membership stays active through the end of the period you've already paid for, and then ends. You keep full access until that date.

5.3 Timing

Cancel at least 7 days before your next billing date so the next charge does not run. If you cancel fewer than 7 days out and a charge has already processed, that charge covers the period you're in and is handled under Section 9 — but email hello@pilogas.com and we will review it with you. We would rather sort it out than have you disputing a charge with your bank.

This 7-day timing does not apply to your free first class. If you are inside a free trial under Section 6, you may cancel at any time before the conversion charge and you will not be charged anything.

5.4 Confirmation

We email you confirming the cancellation and the date your access ends. Keep it. If you don't receive one, your cancellation may not have gone through — email hello@pilogas.com.

5.5 Nothing here limits your rights

If any term in this agreement appears to interfere with, detract from, contradict, or undermine your ability to cancel, that term does not apply to cancellation.

Section 06Your free first class

In plain terms

The free class is genuinely free — but it turns into a paid $99/month Bronze membership on day 8 unless you cancel first. We tell you the exact date, we email you a reminder before it happens, and you can cancel any time before the charge.

6.1 How the free class works

We offer a free first drop-in class at $0. It is a free-to-pay conversion. If you do not cancel within 7 days of claiming it, it automatically converts into a Bronze monthly membership at $99 per month, which then renews automatically every month until you cancel under Section 5.

6.2 What we tell you before you claim it

Before you claim the free class, we disclose clearly and conspicuously, and obtain your separate affirmative consent to:

  • That the class is free for 7 days.
  • The exact date the free period ends.
  • That on that date you will be charged $99 per month for a Bronze membership unless you cancel first.
  • That the membership then renews automatically until you cancel.
  • How to cancel, including the direct link at pilogas.com/cancel.

6.3 Cancel before you pay anything

You may cancel at any point during the 7-day free period and you will not be charged. The acknowledgment we email you when you claim the free class tells you how to cancel and lets you do it before you pay. The 7-day advance notice in Section 5.3 does not apply during the free period.

6.4 Your reminder

We email you a reminder before the free period converts. It states the conversion date, the amount you'll be charged, and how to cancel. Watch for it at the address on your account.

6.5 One per person

The free first class is for new clients, one per person. We may decline or reverse a free class claimed more than once or clearly outside these terms.

Section 07Drop-in classes

A single drop-in group class is $50. Drop-ins are a one-time purchase. They do not renew and they do not convert into anything — the only offer that converts is the free first class described in Section 6.

Drop-ins do not require a reservation. See Section 10.

We do not currently sell multi-class packs or prepaid class credits. If we introduce them, the terms will be disclosed on the product page before you buy.

Section 08Payment authorization

By providing a payment method you represent that you're authorized to use it, and you authorize us and our payment processor to charge it for all amounts due — recurring membership fees, drop-in classes, private training, workshops, mat rentals and purchases, and applicable taxes.

Payments are processed by Stripe. We do not store full card numbers ourselves.

Failed payments. If a charge declines we may retry it and may suspend access until the balance is paid. Keep your payment method current; we'll email you if it needs updating.

Chargebacks. If you dispute a charge you actually authorized, we may suspend or terminate your account and recover the amount plus any fees. Please email hello@pilogas.com first — most billing questions get sorted in one message.

Section 09Refunds

In plain terms

Membership fees aren't refunded — cancelling stops future charges rather than returning past ones. Email us anyway if something went wrong; we'd rather fix it than argue about it.

If we cancel a session — including for weather under Section 12 — we offer a make-up class. If we permanently stop operating, we refund the unused prepaid portion of your membership.

Nothing in this section limits any refund right you have under applicable law, including the California Automatic Renewal Law.

Section 10Showing up and private training

In plain terms

Group classes need no reservation — check the schedule and show up. Private training is booked by email and needs 12 hours' notice to cancel.

10.1 Group classes: no booking required

You do not need to reserve a spot for a group class. Check the class schedule, go to the listed location at the listed time, and join. Because there's no reservation, there are no late-cancel or no-show fees for group classes — if you can't make it, just don't come.

Spots at some locations may be limited by the space itself or by rules set by the agency that manages it. Where that happens, it's first come, first served.

10.2 Private training: booked by email

Private and personal training sessions are arranged by emailing hello@pilogas.com. Once a session is scheduled, it's reserved for you and your instructor's time is committed.

Cancel private training at least 12 hours before the session. Cancelling with less than 12 hours' notice, or not showing up, forfeits the session. We may waive this at our discretion — particularly where weather, illness, or a genuine access problem is the reason.

10.3 Arriving late

Classes are short and start with a warm-up that matters, especially on uneven ground. If you arrive after a class has begun, your instructor may ask you to join at a natural break or wait for the next session. That's a safety call about warming up properly, not a judgment about you.

Section 11Where classes meet

In plain terms

We teach in public parks and on beaches, and the locations move. Check the schedule and your email the morning of class, and give yourself time to park and walk in.

Classes are held at outdoor public locations across San Marcos, Carlsbad, greater San Diego, and Mission Viejo. We do not teach at a fixed set of sites — locations rotate with the season, the weather, and what's available. The current location for each session is listed on the class schedule.

Locations can change on short notice. Public spaces are shared and subject to closures, permits, events, maintenance, crowding, and rules set by the agency that manages them. We may move or relocate a session. We notify you by email at the address on your account as early as we reasonably can, so check your email before you leave.

Getting there is on you. You are responsible for your own transportation, parking, and any park entry or day-use fees. We are not responsible for parking citations, towing, entry fees, or travel costs.

Access. Some locations involve walking over grass, sand, gravel, or uneven paths to reach the meeting point. If you have an access need, email hello@pilogas.com before you come and we'll tell you honestly whether a given location will work for you.

Section 12Weather, air quality, and cancellations

In plain terms

We teach outside, so weather sometimes wins. If we cancel, you get a make-up class. Light rain and wind aren't cancellations — dress for it.

We may cancel or relocate for rain, lightning, high wind, extreme heat, poor air quality, surf or tide conditions, wildfire smoke, park or beach closure, or anything else that makes a session unsafe or unavailable.

How we decide and tell you. We aim to make the call at least 2 hours before start time and notify you by email. Check your email before you leave the house.

If we cancel: we offer you a make-up class. Members lose nothing — your membership continues and you simply attend another session. If you paid for a drop-in for the cancelled class, that drop-in carries over to a session of your choice.

If we don't cancel and you choose not to attend: group classes need no reservation, so nothing happens — just come to the next one. For private training, the 12-hour rule in Section 10.2 applies, though we'll be reasonable about genuine weather calls.

Light rain, wind, cold, and heat are part of outdoor practice and are not on their own grounds for cancellation. Dress for the conditions and see Section 13.

Section 13What to bring and mat rental

Bring what you need to practice safely outdoors:

  • A mat or towel suitable for grass or sand. Everyone brings their own — or rent one from us on the day for $5 per rental. We also sell mats; ask your instructor.
  • Water — more than you think, especially in warm months.
  • Sun protection: sunscreen, hat, sunglasses.
  • Layers appropriate to the forecast and the coastal marine layer.
  • Any personal props, braces, or supports you use.

Mat rentals are subject to availability and are charged per rental, each time you rent. Rented mats are returned to the instructor at the end of class. If a rented mat is lost or damaged beyond ordinary wear, we may charge you its replacement cost.

Bring only what you can keep with you. We are not responsible for personal property that is lost, damaged, or stolen at a class location — these are public spaces and there is nowhere secure to store belongings.

Section 14Conduct in public spaces

We're guests in shared public places. While attending a session you agree to:

  • Follow instructor guidance and all posted rules of the park, beach, campus, or trail we're using — including leash, alcohol, amplified sound, permit, and hours restrictions.
  • Tell your instructor before class about injuries, pregnancy, or anything affecting your practice.
  • Treat instructors, other participants, and members of the public with respect. Harassment, discrimination, threats, and intoxication are grounds for immediate removal and termination without refund.
  • Not photograph or record other participants or members of the public without their consent.
  • Leave no trace: pack out everything you bring, including tape, wipes, and bottles.
  • Not use our sessions to promote a competing business or solicit our clients or instructors.

If a public agency, property manager, or law enforcement officer asks our group to move or disperse, we will comply and may end the session. Where that happens we treat it as a cancellation by us under Section 12 and offer a make-up class.

Section 15Health, risk, and release

In plain terms

Movement carries risk, and moving outdoors adds sun, heat, and uneven ground to it. We're not your doctor. Talk to one before you start, work at your own level, and stop if something hurts.

15.1 Not medical advice

Our classes, instructors, materials, and content are for general fitness and wellness. They are not medical advice, diagnosis, or treatment, and do not replace care from a licensed professional. Consult your physician before beginning any exercise program, especially if you are pregnant or postpartum, recovering from injury or surgery, or living with a cardiovascular, respiratory, musculoskeletal, neurological, or heat-sensitive condition.

15.2 Assumption of risk

You understand that Pilates and yoga carry inherent risks including muscle strain, sprains, joint injury, falls, and aggravation of pre-existing conditions — and that practicing outdoors adds risks an indoor studio does not have, including:

  • Uneven, sloped, sandy, or soft ground, and hidden holes, roots, or rocks
  • Sun exposure, dehydration, heat exhaustion, and heat stroke
  • Cold, wind, damp ground, and slippery surfaces
  • Insects, allergens, pollen, plants, and wildlife
  • Sand, water, tides, and surf at beach locations
  • Other members of the public, cyclists, dogs, vehicles, and equipment in shared spaces
  • Greater distance from immediate medical assistance than at an indoor facility
  • Air quality events including wildfire smoke

You voluntarily assume those risks. You agree to practice within your own limits, hydrate, use sun protection, modify or rest when you need to, and stop and tell an instructor immediately if you feel pain, dizziness, nausea, overheating, or distress.

15.3 Release

To the fullest extent permitted by law, you release Piloga's LLC, its owners, employees, instructors, contractors, and agents from claims for injury, loss, or damage arising out of your participation in the Services, except claims arising from gross negligence, recklessness, willful misconduct, or violation of law, which are not released.

Section 16Your signed waiver

Participation in any PILOGA'S session requires a completed Waiver, submitted before your first class — including before your free first class.

You can reach the waiver from the Contact us page, or from the waiver link in the footer of any page on this site.

Where the signed waiver and these Terms differ, the signed waiver controls for in-person participation. If you have not completed it, you may be asked to do so before class begins or be turned away. Parents or guardians must complete it on behalf of any participant under 18.

Section 17Digital and recorded content

If we make streamed, recorded, or downloadable classes available to you, we grant a limited, personal, non-exclusive, non-transferable, revocable license to access that content for your own non-commercial use while your membership is active.

You may not record, copy, redistribute, publicly perform, screen for a group, or use our content to teach or train others. Doing so ends your license immediately.

Practicing on your own means practicing without an instructor present. Make sure you have clear, level space and apply Section 15 with extra care.

Section 18Our intellectual property

The Site and the Services, including the PILOGA'S name and logo, class names and sequences, videos, photographs, text, graphics, and software, are owned by us or our licensors and protected by intellectual property law. These Terms transfer no ownership to you. Don't copy, adapt, scrape, or make derivative works from the Services without our written permission.

Section 19Content you post

If you post reviews, photos, or comments through the Services, or tag us on social media, you keep ownership and grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it to promote PILOGA'S. You confirm you have the rights to what you post and that it doesn't violate anyone else's rights. We may remove content at our discretion.

We sometimes photograph or film sessions for marketing. We'll say so at the start of class, and you can ask not to be included — just tell the instructor.

Section 20Disclaimers

Except as expressly stated in these Terms and to the fullest extent permitted by law, the Services are provided "as is" and "as available," and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about specific fitness, health, or aesthetic results. We don't warrant that the Site will be uninterrupted or error-free, or that any particular location, instructor, or session time will be available.

Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.

Section 21Limitation of liability

To the fullest extent permitted by law, Piloga's LLC and its owners, employees, instructors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Services.

Our total liability for all claims relating to the Services in any 12-month period will not exceed the greater of $500 or the amount you paid us in the 12 months before the event giving rise to the claim.

These limits do not apply to liability that cannot be limited under applicable law, including gross negligence, willful misconduct, or fraud.

Section 22Indemnification

You agree to indemnify and hold harmless Piloga's LLC and its owners, employees, instructors, and agents from claims, damages, losses, and reasonable legal fees arising out of your violation of these Terms, your misuse of the Services, your violation of any park, beach, or campus rule, your violation of law, or your infringement of another person's rights.

Section 23Disputes and governing law

In plain terms

Email us first — most problems get fixed in one message. If that doesn't work, California law applies and disputes go to California courts.

23.1 Contact us first

Before filing any formal claim, email hello@pilogas.com describing the problem and what you'd like us to do. We'll try to resolve it within 30 days. Most billing and membership issues are settled the same week.

23.2 Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. You and PILOGA'S agree to the jurisdiction of the state and federal courts located in San Diego County, California.

Nothing here prevents you from bringing a claim in small claims court, or from raising an issue with a government agency.

Section 24Changes to these terms

We may update these Terms. When we do, we'll change the "Last updated" date at the top. For material changes affecting your rights or your billing, we'll give advance notice by email or on the Site before the change takes effect. Price changes are governed by Section 4.7.

Continuing to use the Services after a change takes effect means you accept the updated Terms. If you don't accept them, cancel under Section 5.

Section 25Suspension and termination

You may end this agreement at any time by cancelling your membership and stopping use of the Services. We may suspend or terminate your access if you violate these Terms, fail to pay, or behave in a way that endangers or harasses others or jeopardizes our access to a public location. If we terminate you for cause, prepaid fees aren't refunded except where the law requires. If we terminate you without cause, we refund the unused prepaid portion of your membership.

Sections that by their nature should survive termination will, including 15, 16, 18, 20, 21, 22, 23, and 26.

Section 26General terms

Entire agreement. These Terms, our Privacy Policy, and your signed Waiver are the entire agreement between you and us about the Services.

Severability. If a provision is found unenforceable, the rest stays in effect.

No waiver. If we don't enforce a provision, that isn't a waiver of our right to enforce it later.

Assignment. You may not assign these Terms. We may, in connection with a merger, acquisition, or sale of assets, on notice to you.

Force majeure. We're not liable for failure to provide the Services due to events beyond our reasonable control — natural disaster, wildfire, extreme weather, public health orders, park closures, or government action. We'll make reasonable efforts to offer make-up classes or alternatives.

Notices. We may send notices by email to the address on your account or by posting on the Site. Send notices to us at hello@pilogas.com or Piloga's LLC, 2360 Alluvial Ave, Clovis, CA.
